Frequently Asked Questions

Everything You Need to Know
Before We Work Together

12+ years. 100% visa approval rate. Answers to the questions that matter most — from eligibility to delivery.

E-2L-1AEB-5EB2-NIW A USCIS-compliant business plan is not a generic document — it is a legal-strategic exhibit built to satisfy specific adjudication criteria. It includes an executive summary, detailed company description, industry and market analysis (TAM/SAM/SOM), competitive landscape, operational plan, management structure, job creation projections, and a 3–5 year financial model with income statement, cash flow, and balance sheet. For petitions like the E-2, it also demonstrates "substantiality" of investment and managerial control. For EB2-NIW, the plan supports the national interest argument. Each plan is written in formal U.S. business English, tailored to the specific visa category, and structured to address the exact questions an immigration officer will ask.
There is no fixed minimum investment amount for the E-2. USCIS applies a "proportionality test" — the investment must be substantial relative to the total cost of the enterprise. In practice, investments under $50,000 face high scrutiny, while amounts between $80,000–$150,000+ are typically more defensible for small businesses. The key is that the funds must be "at risk," committed, and sufficient to ensure the successful operation of the business. A strong business plan is the primary tool used to justify that the investment is real, proportional, and capable of supporting the operation.
E-2 (Treaty Investor) — Requires investment and treaty country nationality. Non-immigrant visa, renewable indefinitely, no direct path to permanent residence.

L-1A (Intracompany Transferee Manager/Executive) — For executives or managers transferring from a related foreign entity to a U.S. company. Can lead to EB-1C green card. No investment required.

EB-5 (Immigrant Investor) — Direct path to U.S. permanent residence. Requires $800,000–$1,050,000 investment and creation of 10 full-time U.S. jobs.

EB2-NIW (National Interest Waiver) — For professionals with exceptional ability whose work benefits the U.S. No employer sponsor required. Best for academics, researchers, and entrepreneurs in high-impact sectors.

Choosing the right category depends on your nationality, existing business structure, investment capacity, and long-term immigration goals. I help clients navigate this decision as part of the scoping process at no extra charge.
My track record is a 100% visa approval rate across all U.S. and Spain visa business plans delivered to date. No business plan I have authored has been the cause of a denial. That said, I always disclose this honestly: visa outcomes also depend on the attorney's overall petition package, the applicant's personal history, and factors outside the business plan. What I control — the document itself — has never been the reason for a denial. In cases where USCIS has issued an RFE touching on the business plan, I have supported clients and attorneys with supplemental responses.
Yes. If USCIS issues a Request for Evidence specifically related to the business plan — financial projections, market analysis, job creation methodology, or the viability of the enterprise — I provide targeted support to strengthen or supplement the original document. This is quoted separately based on scope, but I prioritize existing clients for fast turnaround given the strict RFE response windows (typically 87 days).
Digital Nomad Spain's Digital Nomad Visa requires a minimum monthly income of approximately 200% of the Spanish SMI — currently around €2,334/month gross. For applicants with dependents, additional thresholds apply per family member (75% of SMI each). Income must come primarily from clients or employers based outside Spain (up to 20% from Spanish clients is permitted). The business plan must clearly evidence the source, consistency, and cross-border nature of this income, including client contracts, invoices, and tax records from your home country.
Ley de StartupsENAC / ENISA Under Spain's Ley de Startups (Law 28/2022), the business plan must demonstrate: (1) an innovative business model with scalable potential, (2) a viable go-to-market strategy, (3) a qualified management team, (4) financial projections showing sustainability and growth, and (5) a positive economic and social impact for Spain. The plan is evaluated by ENAC or ENISA, who issue a binding opinion within 30 business days. I prepare plans specifically structured for this evaluation framework, addressing the criteria these bodies apply — not generic planning standards.
Autónomo Yes. The Autónomo visa requires a business plan demonstrating the economic viability of a self-employment activity in Spain, a defined client base or demand justification, and sufficient financial solvency. I deliver these plans in formal Spanish, formatted for consular submission, and tailored to the specific activity code (CNAE) relevant to your profession. For digital professionals, consultants, creatives, and service providers, I include a market demand analysis showing why the activity is viable in Spain's current commercial environment.
Yes. The business plan I prepare is a standalone document designed for consular submission. You do not legally require an immigration lawyer to apply for most Spanish visa categories — though for complex cases I can refer you to trusted immigration attorneys in Spain. The document is delivered in PDF format, professionally formatted, and ready to attach to your visa application package as required by the corresponding consulate.
TAM / SAM / SOMCompetitive Analysis My market research goes well beyond repacking publicly available reports. A standard engagement includes: total addressable market sizing (TAM/SAM/SOM) with cited methodology, competitive landscape mapping with positioning analysis, customer segmentation and demand drivers, regulatory and entry barrier assessment, and sector-specific risk factors. For U.S. and Spanish markets I use industry databases, government statistical sources (INE, BLS, Census Bureau), and where applicable, proprietary research. The output is a decision-ready document — not a data dump.
Financial Modeling Yes. Every financial model I build includes three scenario versions (conservative, base, and optimistic), sensitivity analysis on the key value drivers (price, volume, COGS, conversion rate), and a break-even analysis. Models are delivered in an editable Excel file with clearly labeled assumption inputs. All models include a 3–5 year P&L, cash flow statement, and balance sheet, formatted to institutional standards suitable for investor presentations, bank submissions, or visa applications.
Both. A significant part of my consulting work involves established businesses seeking to expand into new markets, restructure operations, attract investors, or support M&A processes. For operating companies, I work from your actual financial data to build models grounded in real performance metrics. I also prepare CIM (Confidential Information Memoranda) and SDE (Seller's Discretionary Earnings) analyses for business owners considering a sale, and due diligence packages for investors evaluating a target.
Yes — this is one of my core differentiators. Having worked with Forbes 500-level clients across the United States, Spain, and Latin America, I provide a comparative market entry framework that evaluates each geography across common dimensions: regulatory environment, competitive intensity, customer acquisition dynamics, and capital requirements. For clients entering multiple markets simultaneously, I coordinate deliverables across geographies with a single point of contact and consistent analytical framework.
Standard delivery is 7–10 business days from the moment I have all required information from you. For visa business plans, I also offer an express 3–5 day delivery for clients with imminent consular appointments — available as an add-on. The timeline depends on the complexity of the business and the speed with which you can provide source materials.
You do not need to prepare anything before our first conversation. Once we align on scope, I send you a structured intake form tailored to your specific visa category or consulting project. For visa business plans, this covers: your business concept, target market, proposed U.S./Spain operations, investment amounts, personal background, and any existing documentation. Most clients complete the intake in 2–3 hours. I do not need a first draft from you — that is my job.
Yes. My standard process includes a structured draft review before final delivery. You review the draft, provide feedback, and I incorporate revisions before issuing the final document. All engagements include a defined number of revision rounds (typically two). I do not deliver a "take it or leave it" final document — the process is collaborative and I stay available throughout.
Yes, and I actively encourage it. The most successful visa applications involve close coordination between the business plan and the attorney's legal petition. I communicate directly with legal teams, align the business plan narrative with the attorney's strategic approach, and adjust language or emphasis based on legal guidance. If you do not yet have an attorney, I can refer you to trusted immigration lawyers I have worked with across the U.S. and Spain.
Because the document is not the same. A visa business plan is a legal exhibit reviewed by trained immigration adjudicators — not a pitch deck. The difference between an approved plan and a rejected one is the precision of the market analysis, the credibility of the financial projections, and the alignment of the narrative with the specific legal standard being applied (e.g., "Matter of Ho" for E-2, or the Dhanasar test for EB2-NIW).

I bring an MBA, a Master's in Immigration Law, 12+ years of international business experience, and a 100% approval rate. What you are paying for is the certainty that the document will not be the reason your visa is denied — on an application where the total cost often exceeds $50,000.
No ethical business plan consultant can guarantee visa approval — that decision belongs to a government authority, and multiple factors are outside the scope of the business plan itself. What I offer: unlimited revisions until you are satisfied with the document, direct support in case of RFE related to the business plan, and a transparent track record verifiable through Fiverr Pro reviews from real clients.
On Fiverr Pro, payment is processed through Fiverr's secure escrow system — funds are held by the platform and only released upon your approval of the delivery. For larger custom projects outside Fiverr, I structure payment in two milestones: 50% on project start and 50% upon delivery of the final draft. I do not request full payment before any work is delivered.
My Fiverr Pro profile (@wilbertlinan) contains verified reviews from real clients across visa categories including E-2, EB2-NIW, L-1A, Spain Digital Nomad, and Autónomo. These reviews are authenticated by Fiverr and cannot be fabricated. Beyond reviews, I am transparent about my background: MBA, Master's in Immigration Law, 12+ years advising businesses across the USA, Spain, and LATAM, including Forbes 500-level engagements.
In my experience — and in the view of most immigration attorneys I work with — specialization produces better outcomes. Immigration attorneys excel at legal strategy and representing clients before USCIS. Business plan consultants with an economics and finance background excel at building credible market analyses and financial models. A lawyer writing their own business plans often produces a legally safe but analytically weak document. The best results come from both professionals working in parallel — which is exactly how I operate with the attorneys who refer clients to me.
